Sudoku Monster Terms of Service

1. Acceptance of Terms

Welcome to Sudoku Monster, a game developed and operated by Baloni Games ("we," "our," or "us"). These Terms of Service ("Terms") constitute a legally binding agreement between you and Baloni Games regarding your use of Sudoku Monster and related services (collectively, the "Service").

By accessing, downloading, installing, or using Sudoku Monster in any way, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. Sudoku Monster is available on multiple platforms: WebGL (web browsers), Android, and iOS.

If you are under the age of 13, you may not use the Service. If you are between the ages of 13 and 18, you represent that you have your parent's or guardian's permission to use the Service and to agree to these Terms.

2. Description of Service

Sudoku Monster is a puzzle game that challenges players to solve Sudoku puzzles. Account creation is mandatory to play the game. You must create an account using a valid, unused email address and a password to access and use the Service.

The Service includes:

• Multiple difficulty levels of Sudoku puzzles
• Daily challenges and tournaments
• Competition games and rankings
• Achievement system with badges and skins
• Statistics tracking and brain activity measurements
• User accounts and profiles
• In-app purchases (where available)
• Social features and leaderboards

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice, for any reason.

3. User Accounts

3.1 Account Creation

Account creation is mandatory to play Sudoku Monster. You must create an account to access and use the Service. When creating an account, you must:

• Provide a valid, unused email address that you have access to
• Create a secure password for your account
• Ensure that the email address you provide is not already associated with another Sudoku Monster account
• Provide accurate, current, and complete information
• Maintain and update your account information as necessary
• Maintain the security of your password and account
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

Each email address can only be used to create one account. If you attempt to create an account using an email address that is already associated with an existing account, you will be required to use a different email address or log in to the existing account.

Email Validation: Email validation is not required when creating an account. You can create and use your account immediately after providing your email address and password.

3.2 Unauthorized Email Use

If you believe that your email address has been used to create a Sudoku Monster account without your consent, you may request the deletion of that account. To request account deletion due to unauthorized email use:

• Send an email to [email protected] from the email address that was used without your consent
• Use the subject line: "Unauthorized Account - Request Deletion"
• State clearly that the email address was used to create an account without your consent
• Request the deletion of the account associated with your email address

Important: The deletion request must be sent from the email address in question. We will verify that the request is coming from the email address associated with the account before processing the deletion. This helps protect against unauthorized deletion requests.

Upon receiving a valid request, we will delete the account associated with your email address. The account will be marked as inactive immediately and permanently deleted after 10 days, in accordance with our standard account deletion process.

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree not to share your account credentials with any third party. We are not liable for any loss or damage arising from your failure to protect your account information.

3.4 Account Termination

You may delete your account at any time through the game options menu. Upon account deletion, your account will be marked as inactive for 10 days, after which all personal data will be permanently deleted. We reserve the right to suspend or terminate your account at any time, with or without notice, if you violate these Terms or engage in any fraudulent, abusive, or illegal activity.

5. Intellectual Property Rights

5.1 Our Rights

The Service, including all content, features, functionality, graphics, designs, logos, trademarks, and software, is owned by Baloni Games and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial entertainment purposes only, in accordance with these Terms.

5.2 Your Content

You retain ownership of any content you create, upload, or post within the Service (such as profile pictures, nicknames, or user-generated content). However, by using the Service, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, modify, adapt, publish, and distribute your content in connection with operating and promoting the Service.

5.3 Restrictions

You may not:

• Copy, modify, distribute, sell, or lease any part of the Service
• Reverse engineer or attempt to extract the source code of the Service
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use our trademarks, logos, or brand names without our prior written consent

6. In-App Purchases and Payments

6.1 Purchases

Sudoku Monster may offer virtual items, currency, or other content for purchase through in-app purchases. The availability and pricing of in-app purchases may vary by platform:

• WebGL: Purchases are processed through Stripe
• Android: Purchases are processed through Google Play Store
• iOS: Purchases are processed through Apple App Store

6.2 Payment Terms

All purchases are final and non-refundable unless required by law or as otherwise specified. Prices are displayed in your local currency and may vary by region. You are responsible for any applicable taxes.

Virtual items and currency have no monetary value and cannot be redeemed for cash, exchanged, or transferred. They are licensed to you for use within the Service only.

6.3 Refunds

Refund requests must be made through the platform where you made the purchase:

• Android: Request refunds through Google Play Store's refund policy
• iOS: Request refunds through Apple App Store's refund policy

We reserve the right to refuse refunds if we suspect fraud or abuse.

7. User Content and Conduct

You are solely responsible for any content you post, upload, or transmit through the Service, including your nickname, profile picture, and any messages or communications. You agree that your content will not:

• Violate any applicable laws or regulations
• Infringe upon the rights of any third party, including intellectual property, privacy, or publicity rights
• Be defamatory, libelous, obscene, pornographic, or offensive
• Promote violence, hatred, or discrimination
• Contain spam, advertising, or solicitations
• Impersonate any person or entity

We reserve the right to remove any content that violates these Terms or that we deem inappropriate, without prior notice. We are not obligated to monitor user content but may do so at our discretion.

8. Platform-Specific Terms

8.1 WebGL Version

The WebGL version of Sudoku Monster runs in web browsers and uses cookies for authentication. By using the WebGL version, you agree to our use of cookies as described in our Privacy Policy and Cookie Policy.

8.2 Android Version

The Android version is distributed through Google Play Store. Your use of the Android version is also subject to Google Play Store's Terms of Service. In-app purchases are processed through Google Play Store, and refunds are subject to Google's refund policy.

8.3 iOS Version

The iOS version is distributed through Apple App Store. Your use of the iOS version is also subject to Apple's Terms of Service. In-app purchases are processed through Apple App Store, and refunds are subject to Apple's refund policy.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
• Warranties that the Service will be uninterrupted, secure, error-free, or free from viruses or other harmful components
• Warranties regarding the accuracy, reliability, or availability of the Service
• Warranties that defects will be corrected

We do not guarantee that the Service will meet your requirements or that your use of the Service will be uninterrupted, timely, secure, or error-free. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

11. Indemnification

You agree to indemnify, defend, and hold harmless Baloni Games and its officers, directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of any third party
• Any content you post, upload, or transmit through the Service

12. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the Service will immediately cease
• We may delete your account and all associated data
• All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability

You may terminate your account at any time by deleting it through the game options menu. Upon account deletion, your account will be marked as inactive for 10 days before permanent deletion.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Jurisdiction to be filled in], without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of [Arbitration Organization to be filled in], except where prohibited by law. 15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Baloni Games regarding your use of the Service and supersede all prior agreements and understandings.
